Terms of Service
These Terms of Service govern your access to and use of www.4playessentials.co.za and any purchase made through our website.
The website is operated by 4Play Essentials Pty. By visiting our website, creating an account, placing an order, contacting us, or using our services, you agree to these Terms of Service. If you do not agree with these Terms, please do not use our website or place an order.
These Terms should be read together with our Privacy Policy / POPIA Notice, Cookie Policy, Returns, Refunds & Cancellation Policy, Shipping & Delivery Policy, Legal Disclosures / ECTA Supplier Information, Disclaimer & Product Safety Notice, and Promotions, Rewards & Free Gifts Terms.
1. Adult-only website
Our website and products are intended only for adults aged 18 years or older.
By using this website or placing an order, you confirm that:

2. Online-only store
4Play Essentials operates as an online-only store. We do not operate a public showroom or walk-in retail store.
Orders must be placed through our website or through an approved direct communication channel where we expressly agree to assist manually.
3. Product information
We try to ensure that product names, descriptions, prices, images, sizes, materials, colours, stock status, features and specifications are accurate and up to date.
However, product colours, packaging, measurements, accessories, branding and appearance may vary slightly from images or descriptions due to supplier updates, manufacturing differences, screen settings, batch changes or packaging changes.
Product descriptions are provided for general product information and shopping assistance. They are not medical, therapeutic, relationship, legal or professional advice.
If a specific product detail is important to your purchase decision, please contact us before placing your order.
4. Product use and customer responsibility
You are responsible for choosing products that are suitable for your personal circumstances, experience level and intended use.
You must read all product descriptions, packaging, warnings, instructions, cleaning guidance and safety information before using any product.
You should stop using a product immediately if it appears damaged, defective, unsafe, unsuitable, uncomfortable, painful, irritating or concerning in any way.
We are not responsible for harm, loss or damage caused by misuse, failure to follow instructions, improper cleaning, use with incompatible lubricants or accessories, incorrect charging, incorrect batteries, unauthorised modification, rough handling, water exposure where the product is not waterproof, or use outside the intended purpose of the product.
Nothing in these Terms limits any statutory consumer rights that cannot legally be excluded.
5. Orders
Placing an order through our website is an offer to purchase the selected product or products at the price shown at checkout.
We may accept, decline, cancel, refund, replace or partially fulfil an order where:

a product is out of stock;

a product, price, promotion or stock error occurred;

payment is not received, fails, is reversed or is flagged;

fraud, abuse or suspicious activity is suspected;

delivery details are incomplete, incorrect or unsuitable;

the order appears to breach these Terms or applicable law;

fulfilment becomes impractical due to courier, supplier, stock, system or operational issues;

we are unable to verify the customer or order information where reasonably required.
If we cancel an order after payment has been received, we will provide a refund, store credit, replacement option or alternative solution as appropriate and lawful.
6. Pricing
Prices are displayed in South African Rand and include VAT where applicable unless stated otherwise.
Delivery fees, courier fees, locker fees, remote-area charges, re-delivery fees, return costs or other applicable charges may be added at checkout or communicated before fulfilment.
We may update prices, promotions, product availability and delivery fees from time to time without prior notice.
If a clear pricing or product error occurs, we may cancel the affected order and refund the customer, or offer the customer the option to proceed at the correct price where appropriate.
7. Payment
Payment methods may include PayFast, Ozow/Pay@, Payflex, Happy Pay, EFT, card payments, or any other payment method shown at checkout.
Third-party payment providers process payment information according to their own terms, security measures and privacy policies.
We do not store full card details. We may receive limited payment confirmation information, including payment status, transaction reference, payment method type, refund status, fraud checks and related transaction details.
Orders paid by EFT may only be processed once payment reflects in our account or proof of payment is accepted at our discretion.
You are responsible for ensuring that payment details are correct and that you are authorised to use the selected payment method.
8. Discounts, rewards, promotions and free gifts
Discount codes, rewards, referral benefits, vouchers, sale offers, bundles, free gifts, loyalty points and promotions are subject to our Promotions, Rewards & Free Gifts Terms and any campaign-specific terms displayed at the time.
Unless stated otherwise:

discounts cannot be combined;

discount codes must be applied before checkout is completed;

discounts may exclude sale items, bundles, gift cards, delivery fees or selected products;

free gifts are subject to availability;
-
rewards and referral benefits are not redeemable for cash;

promotions may be changed, paused or ended where lawful;
-
suspected abuse, duplicate accounts, fake referrals, fraudulent activity or misuse may result in cancellation of rewards, discounts, promotions or orders.
9. Delivery
Delivery is governed by our Shipping & Delivery Policy.
Delivery times shown on the website or at checkout are estimates. Actual delivery times may vary depending on payment clearance, order processing, courier availability, public holidays, weekends, weather, strikes, remote areas, incorrect delivery details, failed delivery attempts, locker availability, collection delays, courier backlogs and other factors outside our direct control.
We use third-party courier and delivery partners. Once a parcel is handed to a courier, delivery timing and tracking updates depend on the courier’s systems and processes.
You are responsible for providing accurate delivery information and ensuring that someone is available to receive or collect the parcel.
10. Discreet packaging
Orders are packed discreetly in plain packaging with no external indication of the product contents.
Courier labels may show the sender, recipient name, delivery address, phone number, courier details, tracking number and other information required for delivery.
Discreet packaging does not prevent a recipient, household member, workplace reception, security desk, collection-point staff member, locker user or courier from seeing the parcel if they have access to the delivery location, collection code or parcel.
You are responsible for choosing a delivery address, locker or collection point where you are comfortable receiving private parcels.
11. Returns, refunds and cancellations
Returns, refunds and cancellations are governed by our Returns, Refunds & Cancellation Policy.
Because all products sold by 4Play Essentials are intimate and hygiene-sensitive, opened, unsealed, used or hygiene-compromised products cannot be returned for change of mind unless they are defective, damaged, incorrectly supplied or otherwise covered by applicable law.
Nothing in these Terms or in our Returns, Refunds & Cancellation Policy removes any rights you may have under applicable South African consumer law.
12. Defects, damaged goods and incorrect items
If you receive a defective, damaged or incorrect product, please contact us as soon as possible at sales@4playessentials.co.za with your order number and a clear explanation of the issue.
We may request reasonable evidence to assess the issue, including photos, videos, packaging images, battery or charging checks, batch details, courier packaging, tracking information or a written explanation.
Please do not send intimate images or videos. Evidence should show only the product issue.
Depending on the circumstances and applicable law, we may assist with troubleshooting, replacement, repair, refund, supplier assessment or manufacturer warranty support.
13. Customer accounts
You are responsible for keeping your account details, login information and password secure.
You are responsible for all activity that takes place under your account unless caused by our fault or a security issue within our control.
You must ensure that your billing, delivery, contact and account information is accurate and updated when necessary.
We may suspend or close an account where we reasonably suspect fraud, abuse, misuse, false information, unlawful activity or breach of these Terms.
14. Customer communication
We may contact you by email, phone, WhatsApp, SMS or other reasonable channels for order-related, payment-related, delivery-related, return-related, customer service, fraud-prevention or legal purposes.
Transactional messages are different from marketing messages. Even if you opt out of marketing, we may still send necessary service messages relating to your order, account, delivery, return, refund, product issue or legal rights.
Marketing communications are handled according to our Privacy Policy / POPIA Notice.
15. Reviews, comments and user content
If you submit a review, comment, message, photo, video, testimonial or other content to us, you confirm that the content is lawful, accurate, your own, and that you have the right to submit it.
You must not submit content that is false, misleading, abusive, defamatory, discriminatory, threatening, unlawful, obscene, spam, infringing, or that reveals another person’s private information without permission.
We may moderate, edit for spelling or formatting, refuse to publish, remove or use customer reviews and feedback for customer support, quality control, product improvement and marketing purposes.
We will take reasonable care not to publish personal contact details or unnecessary private information.
16. Prohibited use
You may not use our website, products or services to:

17. Intellectual property
The website, brand name, logos, text, product descriptions, images, graphics, layouts, banners, designs, marketing content and other website materials are owned by or licensed to 4Play Essentials unless stated otherwise.
You may not copy, reproduce, modify, scrape, distribute, display, publish or use our content for commercial purposes without our written permission.
This does not prevent customers from sharing normal links to our website or using website content for lawful personal shopping purposes.
18. Third-party links, platforms and services
Our website may link to or use third-party websites, apps, payment providers, courier platforms, social media platforms, advertising platforms, review tools, product apps, analytics providers, manufacturer websites or other third-party services.
We are not responsible for third-party websites, apps, content, policies, availability, service quality, security, privacy practices, outages, compatibility issues or platform decisions.
Where you use a third-party service, that service may have its own terms and privacy policy.
19. Third-party app-controlled products
Some products may work with third-party apps, Bluetooth features, remote-control functions, partner-control functions or connected-device features.
Third-party app features may depend on device compatibility, app availability, software updates, internet connection, Bluetooth connection, account registration, app permissions and platform rules.
We are not responsible for third-party app outages, app changes, platform removals, compatibility issues, device settings, connectivity issues or privacy practices of third-party app providers.
20. Website availability
We try to keep the website available and working properly, but we do not guarantee uninterrupted, error-free or secure access at all times.
The website may be unavailable or affected by maintenance, updates, hosting issues, internet problems, cyber incidents, third-party provider issues, payment-provider downtime, Shopify issues or circumstances outside our reasonable control.
We may update, suspend, change or discontinue any part of the website where necessary.
21. Accuracy of information
We try to keep website information accurate, but errors may occur.
We may correct product information, prices, promotions, stock availability, delivery information, spelling errors, technical errors or omissions at any time.
If an error materially affects your order, we will contact you where reasonably possible and provide an appropriate option.

We process personal information according to our Privacy Policy / POPIA Notice and Cookie Policy.
By using our website or placing an order, you acknowledge that we need to process certain personal information to operate the store, process payment, fulfil orders, arrange delivery, provide support, prevent fraud, comply with legal duties and communicate with you.
Because of the private nature of the products we sell, we treat customer order information with care and limit access to people and service providers who need the information for legitimate business or legal purposes.
23. Limitation of liability
To the extent permitted by law, 4Play Essentials will not be liable for indirect, incidental, special, punitive or consequential losses, including loss of profits, loss of data, loss of business, reputational harm, emotional distress, embarrassment, courier delays, third-party platform failures, website interruptions, product misuse or reliance on website information.
To the extent permitted by law, our liability for any claim relating to an order is limited to the amount paid for the product or service giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under South African law.
24. No unlawful exclusion of consumer rights
Nothing in these Terms is intended to unlawfully exclude, restrict or limit your rights under the Consumer Protection Act, Electronic Communications and Transactions Act, Protection of Personal Information Act or any other applicable South African law.
If any part of these Terms conflicts with a consumer right that cannot lawfully be waived, the applicable consumer right will apply.
25. Indemnity
You agree to indemnify and hold 4Play Essentials harmless from losses, claims, damages, liabilities, costs and expenses arising from your unlawful conduct, misuse of products, breach of these Terms, fraud, false information, infringement of third-party rights, abuse of promotions or violation of applicable law.
This indemnity does not apply where the law does not allow it or where the loss was caused by our unlawful conduct.
26. Force majeure
We are not responsible for failure or delay caused by events outside our reasonable control, including courier disruptions, supplier delays, strikes, load shedding, power failures, internet outages, system failures, payment-provider downtime, severe weather, natural disasters, civil unrest, war, pandemics, government restrictions, border delays or other events beyond our reasonable control.
27. Termination or refusal of service
We may refuse service, cancel orders, suspend accounts, block access or terminate use of the website where we reasonably believe that a customer has breached these Terms, provided false information, abused staff, committed fraud, misused promotions, attempted unlawful activity or created risk for the business, customers, suppliers or service providers.
Where an order is cancelled, we will deal with any refund, store credit, replacement or deduction in line with applicable law and our published policies.
28. Changes to these Terms
We may update these Terms of Service from time to time to reflect changes in our business, website, products, legal duties, service providers or operating practices.
The latest version will be published on our website with the updated date.
Your continued use of the website after changes are published means you accept the updated Terms.
29. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be limited, amended or removed to the minimum extent necessary, and the remaining provisions will continue to apply.
30. Governing law
These Terms are governed by the laws of the Republic of South Africa.
Subject to applicable consumer rights, disputes will be dealt with by the courts, tribunals, ombuds, regulators or dispute-resolution bodies having jurisdiction in South Africa.
